1. Acceptance of Terms
By accessing or using Chooseday ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and workspace owners.
2. Description of Service
Chooseday is a group decision-making platform that allows users to create decisions, share voting links, and view aggregated results. The Service is provided via the web application at app.chooseday.co and related domains.
3. User Accounts
You must create an account to use most features of the Service. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use
You must be at least 16 years old to create an account. By registering, you confirm you meet this requirement.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Harass, threaten, or harm other users
- Upload or share content that is unlawful, defamatory, obscene, or infringes on third-party rights
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use automated tools to scrape, crawl, or abuse the Service without prior written permission
- Impersonate any person or entity
We reserve the right to suspend or terminate accounts that violate these rules.
5. Workspaces and Team Data
When you create a workspace, you are the workspace owner and are responsible for managing members and the decisions created within it. Decisions and votes within a workspace are visible to workspace members based on their assigned role. You are responsible for ensuring you have appropriate permissions before adding others to your workspace.
6. Intellectual Property
All content, branding, and software comprising the Service are owned by Chooseday or its licensors and are protected by applicable intellectual property laws. You retain ownership of any content you create (decisions, options, descriptions) and grant Chooseday a limited licence to store and display that content solely for the purpose of operating the Service.
7. Privacy
Your use of the Service is also governed by our
Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described therein.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Chooseday shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
9. Changes to the Service and Terms
We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email or in-app notification. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
10. Termination
You may delete your account at any time via Settings. We may suspend or terminate your account at our discretion if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
